Trade Offences Act

The Government of the Trade Federation was founded on the principles of honour, intergrity and profit.

In accordance with the second of these principles, and in relation to the first and third, the following act defines offences related to trading, and their respective punishments. All offences listed herein are outlawed in all Trade Federation or Confederate space by all, and to all members of the Trade Federation and Confederacy, irrespective of their location, and thus apply to all satsifying one or more of these prerequisites.

Section 1: Definition of Offences

1. Theft refers to any action, deliberate or otherwise, whereby an individual or group of individuals are in possession of any assets that are property of another and make no effort to return said assets to their rightful owner(s).

2. Attempted Theft refers to the attempt of any action, deliberate or otherwise, that would result in an individual or group of individuals having possession of assets that are property of another.

3. Deceptive Trading refers to the sale or attempted sale of assets without stating details that may prove detrimental to the purchaser.

Section 2: Exceptions to the definition of 'Theft'

1. In the case of reclaiming recently stolen assets, each case is reviewed individually and, depending on the methods used and circumstances in which it was undertaken, a pardon may be issued. (Incarceration is required as in Section 3 until the defendant is proven innocent.)

2a. In the case of spoils of war, items designated as 'targetable' can be taken.

2b. Any attempt (successful or otherwise) that results in ownership of items not designated as 'targetable' by either the Trade Federation or Confederate Council is punishable according to Section 3.

Section 3: Punishment of Offences

In all cases of trade offence, suspected offenders are to be incarcerated as soon as possible, and not released until judgement is passed and the punishment is served (if necessary).

1. Theft from the State or a state-owned or affiliated company is punishable by death under Trade Federation law.

2. Theft from an individual is immediately punishable by incarceration and a fine, both of which to be determined by the residing judge. Once the sentence is served, the offenders are exiled from the Trade Federation, its affiliates and their respsective sovereign territory. If the stolen assets are not returned immediately, a death sentence is to be administered.

3. Attempted theft is punishable by a fine to be determined by the residing judge and, upon completion of payment, exile from the Trade Federation, its affiliates and their respective sovereign territories.

4. Deceptive trading is punishable by a fine to be determined by the residing judge, which is to be paid to the recipient in question, followed by a public apology to the galactic trading community. ((OOC: The Trader's Forum.))

5. Recidivism, in the cases of theft and attempted theft is punishable by death. In the case of deceptive trading, the offender is exiled from the Trade Federation, its affiliated and their respective sovereign territories, in addition to punishment in conjunction with that of a first offence (See section 3.4).

Section 4: Rights of the Defendant

1a. The defendant, in the cases outlined in Section 3.2, 3.3 and 3.4 are entitled to legal consul at all times during their incarceration, in addition to legal representation, though these must be arranged by the defendant.

1b. The defendant, in the cases outlined in Section 3.1 and 3.5, is not entitled to legal aid of any form, and is not guaranteed a trial by jury. Instead, the reviewing body may consist of affected persons and respresentatives from affected factions, at the behest of the Viceroy.

2. In cases outlined in Section 2, the defendant has the right to legal aid at all times and in all situations, though these must be arranged by the defendant. The right to legal aid is forfeited if the defendant is found to have acted as described in either Section 3.1 or 3.5.

Section 5: Definition of Terms

Details that may prove detrimental to the purchaser are listed as, but not limited to; Unpowered status, Arrested status, Docked status, Location (if hostile territory), Damaged status, Employment ratio of city (if a facility and more than 0.5 either way of the recommended ratio of 1.5), Debt status.

'Targetable' items are listed as, but not limited to; Wrecks, Ships, Facilities, Vehicles of any designated protagonist, as defined by the leadership of the Trade Federation and the Confederacy of Indepedent Systems.

In any circumstances where the punishment is a fine, the fine itself must be greater than the value of the stolen (or potentially stolen) assets and, whilst the amount is the jurisdiction of the residing judge, is recommended to be two - four times the value of the assets in question.
